Terms and Conditions

Elysium Breathwork (“Elysium”, “we”, “us”)
Effective date: [01.01.2025]

 

1. Scope & Acceptance

These Terms govern: (a) in-person and online ceremonies; (b) 1-to-1 online consultations for mental-health support (non-medical wellbeing/coaching); (c) our e-shop (physical goods and digital downloads); and (d) passes, vouchers, and bundles. By using our website, booking, or purchasing, you accept these Terms and our Privacy Notice.

 

 

2. Eligibility & Participation

 

• Age: Events are 18+. Minors only with written guardian consent and guardian presence.

• Health: You must read our Health Screening and self-confirm you are fit to participate. We do not collect or store health information; please do not send medical details. We may adapt or refuse participation for safety.

• Local laws: You must comply with applicable laws when accessing our online services

3. Booking & Payment (Ceremonies)

3.1 Confirmation A booking is confirmed only when you receive our confirmation email.

3.2 Prices. Prices may change prospectively and do not affect confirmed bookings.

3.3 Payment methods. Default is card via secure checkout. Alternative methods (e.g., bank transfer, TWINT, cash on site) are possible only by prior written arrangement. If agreed, we may hold your seat for a limited time (e.g., 24 hours). If payment is not received by the deadline, we may release the seat. Cash is accepted only in exact amount and by exception.

3.4 Conduct & arrival. Arrive on time, follow facilitator guidance, and respect others’ boundaries. Disruptive or unsafe behaviour may lead to removal without refund.

3.5 Substances. No alcohol or recreational drugs for 24 hours before a session.

3.6 Supportive touch consent. Only if you opt in at check-in; you may revoke consent at any time.

3.7 Late arrivals. After the opening circle, entry may be delayed or declined to protect the space; this is treated as a no-show under Section 4.

4. Cancellations, Transfers & Credits (Ceremonies, Events and 1-to-1 Consultations - online / offline)

Scope and timezone. Applies to single-event tickets and 1-to-1 sessions. All deadlines use Europe/Zurich time.
How to cancel. Email only to info@elysiumbreathwork.ch from the purchaser’s email. Cancellations via phone/DM/social are not accepted. A cancellation is effective when received in our inbox.

4.1 Your cancellation

• More than or equal to 48 hours before the start: 100% credit voucher (valid 12 months) issued by default; or refund on request to the original payment method, minus a 3% payment/admin fee.
• Less than 48 hours before the start or no-show: No refund and no credit.​

4.2 Transfers You may transfer your ticket/slot to another adult. Email us the new participant’s full name and email before the start time.

4.3 Our reschedule/cancellation
If we change date/time or cancel, you may choose a full refund or a 100% credit (12 months). We are not liable for external costs (e.g., travel, lodging).

4.4 Force majeure
For events outside our reasonable control (e.g., venue closure, government measures, extreme weather, strikes, epidemics/pandemics), we will offer rebooking or credit consistent with the above.​

5. Breather Pass — 5 Entries (Ceremonies)

5.1 Validity. 12 months from purchase.
5.2 Using a pass. Each confirmed reservation deducts 1 entry.
5.3 Cancelling a pass booking.
• More than or equal to 48 hours before the start: the entry is re-credited to your pass.
• Less than 48 hours before the start or no-show: the entry is deducted (no refund/credit).
5.4 Refunds.
• Within 7 days of purchase and 0 entries used → money back to the original payment method (full refund).
• After 7 days or if any entry is used → non-refundable.
5.5 Transferability. You may transfer unused entries to another adult—email us to register their details.
5.6 Extensions. Passes do not auto-extend. For documented medical reasons, we may grant a one-time extension up to 2 months at our discretion.

 

6. 1-to-1 Bundles / Packages (Mental-Health Online Consultations)

6.1 Nature of service. Non-medical wellbeing/mental-health support and coaching; not psychotherapy or medical treatment; does not create a patient-provider relationship. Not for emergencies.
6.2 Validity. 12 months from purchase.
6.3 Cancelling a booked session.
• More than or equal to 48 hours before the start: the session credit is returned to your bundle.
• Less than 48 hours before the start or no-show: the session credit is deducted.
6.4 Refunds.
• Within 7 days of purchase and 0 sessions used → money back to the original payment method (full refund).
• After 7 days or if any session is used → non-refundable.
6.5 Transferability. You may transfer unused bundle credits to another adult—email us to register their details.
6.6 Extensions. One-time up to 2 months for documented medical reasons at our discretion.

 

7. Vouchers (Gift & Credit)

7.1 Validity.
• Gift vouchers (purchased): 2 years from issue. If you need a longer period, email info@elysiumbreathwork.ch and we will arrange an extension.
• Credit vouchers (issued for cancellations/service adjustments): 12 months from issue.
7.2 Redemption & remainder.
• Single-use per checkout. Vouchers are redeemed in one checkout.
• If your order total is lower than the voucher value, we issue a new voucher for the remainder with the same expiry.
• No cash payout.
7.3 Transferability. Gift vouchers are transferable. Credit vouchers are non-transferable unless we agree in writing.
7.4 Loss. If verifiably unused and unredeemed, we may reissue; an admin fee may apply.

 

8. E-Shop (Physical & Digital Products)

8.1 Orders & payment. Pay at checkout (card). Alternative methods may be agreed in writing before dispatch.
8.2 Shipping. Dispatch aim 3–5 business days; carrier/customs delays are outside our control.
8.3 Returns (physical goods). You may return unused, unopened items within 14 days of delivery for refund to the original method; you cover return shipping unless defective/incorrect.
8.4 Digital products. Non-refundable once access is provided.
8.5 Defects & warranties. Statutory remedies apply in addition to any commercial warranty stated on product pages.
8.6 Pricing & errors. We may cancel orders and refund you in case of obvious price/stock errors.

 

9. Health & Safety (All Events)

You confirm you have read our Health Screening, are aware of the participation guidelines, and are fit to participate. You may stop or modify participation at any time and request support. In an emergency, you consent to us seeking appropriate medical assistance.

 

10. Photos/Media

 

We do not publish identifiable photos/audio/video of participants without explicit, separate opt-in consent. You may withdraw consent later; we will stop future use where feasible.

 

11. Intellectual Property

All site and event materials (text, audio, images, logo, program content) are owned by Elysium or licensors. Personal, non-commercial use only. Do not copy, record, stream, or distribute without written permission.

12. Disclaimers

Services are provided “as is” and “as available”; we do not warrant uninterrupted availability. Facilitators are not acting as medical providers; our offerings are not a substitute for medical/psychological treatment. Online content is for education/wellbeing only.

 

13. Liability

To the maximum extent permitted by Swiss law, we exclude liability for indirect, incidental, or consequential losses and cap total liability to the amount you paid for the affected event/order. Nothing in these Terms limits or excludes liability for willful intent or gross negligence, or other liability that cannot be limited/excluded under Swiss law.

 

14. Data Protection (nFADP; GDPR where applicable)

 

We process standard personal data (e.g., contact and booking data) to administer bookings, provide services, and communicate with you. We do not request or store health information via our website or booking forms; please do not send medical details to us. 15. Website Legal Notice / Imprint

We publish our operator identity and contact address (including email) clearly on the site, as required for Swiss e-commerce.

 

16. Governing Law & Jurisdiction

Swiss law governs these Terms.

• Consumers: Mandatory consumer-protection and jurisdiction rules remain reserved; you may have the right to bring claims at your domicile.

• Business customers (B2B) only: Exclusive forum is Zurich, Switzerland.

 

17. Payment Issues & Chargebacks

If a card chargeback is initiated, we may suspend access/benefits to the related booking or digital product while the matter is reviewed, and we may seek recovery of external fees if the chargeback is rejected. This does not limit any statutory rights.

 

18. Changes to Services & Terms

We may update services and these Terms at any time. The version in force at the time of booking/purchase applies to that transaction. Material changes will be posted with effective dates.

 

19. Severability, Assignment, Entire Agreement

If any provision is invalid or unenforceable, the remainder remains effective. You may not assign your rights without our consent; we may assign to a successor entity. These Terms are the entire agreement for the scope above.
